Résumé
This thesis investigates interactions between New Technologies (NTs) and Intellectual Property Rights (IPRs, mainly patents and copyrights). To what extend these interactions lead to à redefinition the status and use of IPRs? What part do IPRs play in the crea tion and innovation process? The context that took place in the beginning of the 1990's underlines some issues inherent to the IPRs system, while creating new distortions, as shown by the software industry in the United States, which is in fast growth and the field of many legal changes. This thesis aims to analyze some aspects of interactions between IPRs and NTs, related to the issues that go along with the new order. We study practical aspects of IPRs implementation in the ITs. We try to characterize the new order from three angles, each one being a chapter.
Cette thèse étudie les interactions entre les Nouvelles Technologies (NT) et les Droits de Propriété Intellectuelle (DPI). Dans quelle mesure ces interactions entraînent-elles une redéfinition du statut et de l'utilité des DPI? Quel rôle les DPI jouent-ils dans les pro cessus d'innovation et de création? La configuration mise en place depuis le milieu des années 1990 amplifie certains dysfonctionnements inhérents au système des DPI tout en introduisant de nouvelles distorsions, comme l'illustre pertinemment le secteur des logi ciels aux États-Unis, en forte croissance et terrain de nombreuses évolutions juridiques. Cette thèse analyse certains aspects des interactions entre DPI et NT à la lumière des dys fonctionnements qui accompagnent la nouvelle donne. Nous étudions les aspects pratiques de la mise en oeuvre des droits dans le contexte des NT. Nous tentons de caractériser la nouvelle donne sous trois perspectives, chacune d'entre elles correspondant à un chapitre.
