La protection de la propriété intellectuelle et l'innovation : contributions empiriques et théoriques

Abstract : This thesis in industrial organization is analyzing firms' strategies for the protection of their intellectual property. Welfare analysis of such strategies is provided, as well as details of their impact on market competition. The first two articles, following an empirical approach, study the protection of IP for French firms using the Community Innovation Survey 4. We disentangle two opposite effects involved in how firms chooses to protect their innovation with a patent or not. The analysis is conducted with a bivariate probit model and shows that, in the intermediate goods industry, small innovation have a higher probability of being patented, while secrecy is more likely to be used to protect a large innovation than a small one. In the third article, "Imitation and Intellectual Property Protection: The Strategic Implications of Damage Rules", we model how the legal framework which the firm is facing influences its patenting behavior. The fourth article, "Adoption Strategies with an Imperfectly Competitive Technology Market", we are relaxing the implicit assumption of perfect competition in the the technology market made in Fudenberg and Tirole (1983). An upstream firm with market power seeks to capture the downstream profits, e.g. with the fixed-part of a two-part tarriff. We show that, when the upstream market is monopolized, in equilibrium there is no preemption race among downstream firms.
